Terms of Service — Spanish Links

These Terms of Service ("Terms") govern your access to and use of the Spanish Links mobile application (the "App"), operated by Zachary Hoshio Frizell ("we," "us," or "our"), a sole trader based at 17 St. John's Terrace, Lewes, BN7 2DL, United Kingdom. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Spanish Links is a mobile application that helps users learn Spanish through daily puzzle-based games and related content. Some features are available for free; additional features require an active paid subscription ("Premium" or "Full Access").

2. Eligibility

You must be at least 16 years old, or the age of digital consent in your country, to use the App. If you are under this age, you may only use the App with the involvement of a parent or legal guardian.

3. Subscriptions

3.1 Subscription Plans

We offer the following auto-renewing subscription plans, prices are shown in the App and may vary by region and currency:

3.2 Billing Platform

Depending on the device you use, your subscription is purchased through and billed by either:

Your payment, billing, and account information for the subscription is held and managed by Apple or Google, not by us. We do not have access to your full payment card details.

3.3 Auto-Renewal

Subscriptions automatically renew for the same duration and at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase (subject to any price changes we notify you of in advance, as required by law).

3.4 Managing or Cancelling Your Subscription

You can manage or cancel your subscription, and turn off auto-renewal, at any time through your device's account settings:

Cancelling stops future billing but does not refund any amount already charged for the current period, and you will retain access to Premium features until the end of the period you already paid for.

3.5 Free Trials (if offered)

If a free trial is offered, it will automatically convert into a paid subscription at the end of the trial period unless you cancel before the trial ends. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial period, where applicable.

3.6 Refunds

All purchases are billed by and refunds are handled by Apple or Google in accordance with their own refund policies, not by us directly:

4. User Conduct

You agree not to: misuse the App, attempt to reverse-engineer or interfere with its operation, use it for any unlawful purpose, or attempt to circumvent any subscription or payment mechanism.

5. Intellectual Property

All content within the App, including but not limited to text, graphics, puzzles, learning content, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. User-Generated Content

If the App allows you to submit content (e.g. profile information, feedback), you retain ownership of it, but grant us a license to use it as necessary to operate and improve the App.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that use of the App will result in any particular level of language proficiency or learning outcome. We do not warrant that the App will be uninterrupted, error-free, or secure at all times.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death, personal injury, or fraud.

9. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms. You may stop using the App and cancel your subscription at any time as described in Section 3.4.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Nothing in these Terms affects your statutory rights as a consumer under UK or EU consumer protection law, where applicable.

12. Apple-Specific Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and us only, not with Apple, and Apple has no responsibility for the App or its content. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, legal compliance claims, or claims under consumer protection law. Apple is a third-party beneficiary of these Terms and may enforce them against you.

13. Google Play-Specific Terms

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. In the event of a conflict between these Terms and Google Play's terms regarding billing, Google Play's terms will govern for purchases made through that platform.

14. Privacy

Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
